Job Applicant Privacy Notice
This notice is addressed to all the candidates who send CV spontaneously or as part of human resources process to Protea S.r.l. or Protea Sud S.r.l. company in compliance with art. 13 d. lgs. 30 June 2003 n°196 – “Personal data protection Code” and of art. 13 GDPR 679/16 – “Personal data protection European regulation”.

Controller’s Identity
Controller of customers’ data (natural or legal persons) or data of natural and legal persons acting on behalf of customers, is Mr. D’Apote Antonio Fortunato the Sole Administrator of Protea S.r.l. headquarters in Via Guglielmo Marconi 7 DRUENTO (TO), 10040 – DRUENTO (TO).
DPO has not been appointed.

Data Source
The personal data processed are those provided by the interested party on the occasion of:

• visits to the offices;
• interactions through the website;
• requests for information, including by e-mail;
• previous transactions.

Purpose of the treatment
Finally, all personal data of the interested parties will be included in the Data Controller’s archives and used (having regard to Article 130 paragraph 4 of Legislative Decree 196/2003 and also considering the General Provision of the Guarantor GU 1 July 2008 No. 188 / C, formulation 6, points a, b, c) for sending communications concerning products, services, news and promotions.

Data processing legal basis
Legal basis is represented by a response to a pre-agreement request of the interested party.

Data recipients
Personal data processed by controller will not be shared with indeterminate subjects, they will not be available in any kind of form. Data may be transferred, within necessary strict limits to other responsible parties insofar as if this is necessary for the contract performance, we or the third party has a predominantly justified interest in the transfer or if you have given your consent. In particular, due to their specific roles, some of Protea S.r.l. employees have been entitled to process personal data, within the limits of their competences and in compliance with the instructions given by Controller.

Data transfer
Personal data Controller does not transfer personal data to third Countries or international organizations. However, he reserves the right to use in cloud services: in this case, services suppliers will be chosen among the ones offering suitable warranties, as provided by art. 46 GDPR 679/16.

Data storage
Controller keeps and process personal data for the necessary time to perform the indicated scope. In particular, all the above-mentioned data will be kept for a period no longer than thirty months from receipt.

Data subject rights
With reference to art. 7 of d.lgs. 196/2003 and artt. 15 – right to access, 16 – right to rectify, 17 – right to cancel, 18 – right to processing limitation, 20 – right to portability, 21 – right to oppose, 22 right to oppose to automatic decisional process of GDPR 679/16, the data subject exercises its rights by writing to the abovementioned processing Controller, or by email, indicating his request object, the right he intends to exercise and attaching IC copy to legitimate his request.

Consent Withdrawal
With reference to art. 23 of d.lgs. 196/2003 and art. 6 of GDPR 679/16, the data subject can withdraw anytime his consent given. However, the processing object of this notice is licit and allowed also without consent, because finalized to pre-agreement measures (application evaluation and candidates selection) adopted upon data subject implicit request.

Claim proposition
The data subject has the right to propose a claim to the controller authority of his country of residence.

Data provision refusal
The data subject can refuse to provide the controller with his personal data. Data provision is optional, but any eventual refusal to provide all/part of data may interfere with recruitment process and the possibility to evaulate his application properly.

Automatic decisional processes
Controller does not perform any automatic decisional process on the data provided by candidates who spontaneously send CV or as part of a recruitment process.
